Terms of Service
These Terms of Service ("Terms") are an agreement between you and Sheekar ("we," "us," or "our"). They apply whenever you use the Sheekar mobile application, this website, or anything else we offer under the Sheekar name (together, the "Services").
Sheekar is an exam preparation app for Grade 12 students in the Kurdistan Region of Iraq, built around the real national exam papers. Please read these Terms before you create an account or buy anything. If you do not agree with them, please do not use the Services.
SUMMARY OF KEY POINTS
Your account is yours alone. One person, one account. Sharing your login so that other people can use content you paid for is the main thing these Terms forbid. Learn more about your account and devices and sharing.
Paid access lasts for a fixed period and does not renew by itself. Sheekar Pro plans and individual testbank purchases give you access for a set number of days. Nothing charges you again automatically, and there is no subscription to cancel. Learn more about paid access.
Purchases are generally final. Because access is granted immediately and the content is delivered to your device, we do not offer refunds as a matter of course. We do fix genuine payment problems. Learn more about refunds.
The exam content is licensed to you, not sold. You may use it to study. You may not copy it out of the app, republish it, or resell it. Learn more about our content.
We do not promise an exam result. Sheekar is a study tool. Past papers, answers and explanations are provided in good faith but are not guaranteed to be free of error, and they are not official. Learn more about availability and accuracy.
If you are under 18, you need a parent or guardian's permission to use Sheekar and to buy anything. Learn more about who may use Sheekar.
1. AGREEMENT TO THESE TERMS
By creating an account, signing in, or otherwise using the Services, you confirm that you have read these Terms and agree to be bound by them. If you are using the Services on behalf of someone else — a child, a student, or a group — you confirm that you have the authority to accept these Terms for them.
Our Privacy Policy explains how we handle your personal information. It forms part of these Terms, so please read it too.
2. WHO MAY USE SHEEKAR
The Services are intended for students preparing for the Grade 12 national examinations in the Kurdistan Region of Iraq, and for the teachers and families who support them.
If you are under the age of 18, you may use the Services only with the involvement and consent of a parent or legal guardian, and any purchase must be made or approved by them. By using the Services, you confirm that this is the case.
You may not use the Services if we have previously terminated your account, or if doing so would break any law that applies to you.
3. YOUR ACCOUNT
You will need an account to use most of Sheekar. You can create one with an email address and password, with a phone number, or through Google or Apple sign-in.
You agree to:
- give accurate information when you register, and keep it up to date
- keep your password and any verification codes to yourself
- tell us at [email protected] if you believe someone else has used your account
An account belongs to one person. You are responsible for everything that happens under your account, including any purchases made through it.
You can delete your account at any time from inside the app. Deleting your account ends your access to any paid content, and we do not refund the unused part of it.
4. DEVICES AND SHARING
Your account may be signed in on a limited number of devices at a time. If you sign in on a new device beyond that limit, the app may sign you out elsewhere. This is a normal part of the service and not a fault.
Sharing your account credentials so that other people can use content you have paid for is a breach of these Terms. Where we offer a multi-person plan, each person covered by it must use their own separate account.
5. PAID ACCESS, PLANS AND CODES
Some content is free and some requires payment. There are three ways to get paid access:
Sheekar Pro
A plan that unlocks the paid content for a fixed number of days, counted from the moment the payment succeeds. We offer plans for a single person and plans covering several people, and their prices and durations are shown in the app at the time of purchase.
Individual testbanks
You can buy access to a single testbank on its own, rather than taking a full plan. That purchase covers that testbank only.
Codes
We and our partners sometimes issue codes that can be redeemed in the app for access. A code may only be redeemed once, may expire, and has no cash value. We may cancel a code that was obtained or distributed in a way these Terms do not permit.
Paid access does not renew automatically. When the period you paid for ends, access to the paid content simply stops. Nothing is charged again unless you choose to buy again, and there is no recurring subscription to cancel.
We may change our prices, plans and what each one includes. Changes never affect access you have already paid for.
6. PAYMENTS
Payments are processed by our payment provider, not by us directly. We do not receive or store your full card or bank details. Your payment is also subject to the provider's own terms.
Access is granted once we receive confirmation that the payment has succeeded. If a payment is taken but access does not appear, contact us at [email protected] with the details and we will resolve it.
You are responsible for any bank charges, transfer fees or taxes that apply to your payment.
7. REFUNDS
Paid access is delivered immediately and in full, so purchases are final and we do not offer refunds simply because you changed your mind or stopped using the app.
We will put things right where something has genuinely gone wrong, including:
- you were charged more than once for the same purchase
- your payment succeeded but access was never granted, and we cannot grant it
- a purchase was made from your account without your authorisation
Write to us at [email protected] within 14 days of the charge and include the payment reference. Nothing here limits any refund right you have under the applicable law.
8. THE REFERRAL PROGRAMME
Sheekar may let you invite other students and earn a reward when they join or subscribe. Rewards are a benefit we offer voluntarily, not something you buy, and they have no cash value.
You may not create fake accounts, refer yourself, use automated tools, or advertise your referral link in a misleading way. We may withhold or reverse a reward, and close the accounts involved, where we believe the programme has been abused. We may change or end the programme at any time.
9. OUR CONTENT AND WHAT YOU MAY DO WITH IT
The Services, and everything in them — the app, this website, our name and logo, the question sets, the answer explanations, the translations and the way it is all organised — are owned by us or licensed to us and are protected by copyright and other laws.
We give you a personal, limited, non-exclusive, non-transferable licence to use the Services and the content you have access to, for your own study only, for as long as your account and any paid access remain active. The content is licensed to you, not sold.
You may not:
- copy, extract, scrape, record or export the content, whether by hand, by screenshot or by any automated means, other than for your own personal revision
- publish, share, sell, rent, sub-licence or otherwise make the content available to anyone else
- use the content to build, train or populate another product, dataset or service
- remove, bypass or interfere with the encryption or any other technical measure that protects the content
- reverse engineer, decompile or disassemble any part of the Services, except to the extent the law expressly permits it
The national examination papers themselves are public documents. Our compilation, correction, translation, explanation and presentation of them is not, and it is that work these restrictions protect.
10. WHAT YOU SUBMIT TO US
The app lets you send us things — reports about a question you believe is wrong, messages to our support team, and the profile details you enter. You keep ownership of what you submit.
By submitting it, you give us permission to use it to operate and improve the Services. In practice that means reading your report, correcting the question, and keeping the correction in the app for everyone.
You are responsible for what you submit. Do not send us anything unlawful, offensive, or belonging to someone else. We may remove any submission and are not obliged to act on any report.
11. ACCEPTABLE USE
When using the Services you agree not to:
- access any part of the Services, or anyone else's account, without permission
- probe, scan, overload or disrupt our systems, or attempt to defeat our security
- use bots, scripts or emulators to interact with the Services
- impersonate anyone, or misrepresent your affiliation with us
- use the Services to harass, threaten or harm another person
- upload anything designed to damage or interfere with software or data
- use the Services for anything unlawful, or in breach of exam board rules
12. AVAILABILITY AND ACCURACY
We work hard to keep Sheekar accurate and available, but we cannot promise either without qualification.
Accuracy. Questions, answers, explanations and translations are prepared with care and corrected when errors are reported, but they may still contain mistakes and they are not official. They are not a substitute for your textbooks, your teachers, or anything published by the examination authorities. We do not guarantee any particular exam result.
Availability. The Services may be unavailable at times for maintenance, updates, or reasons outside our control, including problems with the internet, app stores, or our suppliers. Some features need a working internet connection.
Change. We may add, change or remove features, content and testbanks. If we withdraw content you have paid to access before the period you paid for has ended, contact us and we will make it right.
13. APP STORE AND GOOGLE PLAY
If you installed Sheekar from the Apple App Store or Google Play, that store's own terms apply to you in addition to these Terms.
These Terms are between you and us, not between you and Apple or Google. Apple and Google are not responsible for the app or its content, and have no obligation to provide support for it. If the app fails to conform to any warranty Apple is required to give, you may notify Apple and Apple may refund the purchase price of the app; beyond that, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. SUSPENSION AND TERMINATION
You may stop using the Services at any time and may delete your account from within the app.
We may suspend or terminate your account, with notice where reasonably possible, if you breach these Terms, if we are required to by law, or if we reasonably believe your use is harming other users or our systems. Where a breach is serious — for example, distributing our content or abusing the referral programme — we may act immediately and without a refund.
Sections that by their nature should survive the end of this agreement will do so, including sections 9, 15 and 16.
15. DISCLAIMERS AND LIABILITY
To the fullest extent permitted by the applicable law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by the applicable law, we are not liable for indirect, incidental, special or consequential loss, for lost data, or for any examination outcome. Our total liability to you for any claim relating to the Services is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
16. GOVERNING LAW
These Terms are governed by the laws in force in the Kurdistan Region of Iraq and the Republic of Iraq. The courts of Erbil have jurisdiction over any dispute arising from them, without prejudice to any right you may have to bring a claim where you live.
If any part of these Terms is found to be unenforceable, the rest continues to apply. Our not enforcing a term on one occasion does not mean we give up the right to enforce it later.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this page. If we make material changes, we will make a reasonable effort to tell you, for example through a notice in the app.
Continuing to use the Services after a change takes effect means you accept the updated Terms. If you do not accept them, please stop using the Services and delete your account.
